Welcome to the New Longevity Brain (referred to as“Service”collectively referred to as “we” “our” “us” “Ashoka), dedicated to harnessing collective wisdom to support changemakers. Our mission is to empower social innovators and key stakeholders to better understand the complex ecosystems in which they operate, ensuring that the solutions and collaborations they design are both effective and impactful. To achieve this, we gather and provide access to reliable expert information, transforming accumulated knowledge into actionable insights that address systemic challenges and scale innovations responding to the opportunities and challenges of aging, whether locally or globally.  

These Terms of Use ("Terms") govern your access to and use of the Platform and its services. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform. 

 

1. Use of the Platform 

  • These Terms of Use apply to your use of all aspects of the Platform and the services provided therein. 

  • The Platform includes all digital interfaces through which the Service is accessed, such as the Website, mobile applications, and communication tools like WhatsApp and other messaging services. 

 

2. Eligibility and User Responsibilities 

The Platform is intended for use by individuals aged 18 years or older. By accessing or using the Platform, you represent and warrant that you meet this eligibility requirement. However, if you are under 18 years of age, you may use the Platform only with the consent and supervision of a parent or legal guardian. Users of the Platform agree to use the Platform solely for lawful purposes and in a manner consistent with these Terms and any applicable laws and regulations. Users are responsible for ensuring the accuracy and authenticity of any information they provide to the Platform. 

 

3. Access to Services 

We strive to ensure that the Platform remains accessible to users. However, we do not guarantee uninterrupted or error-free access and may modify, suspend, or terminate the Platform or any part of its services without prior notice. Users agree that we are not liable for any disruptions or modifications that may affect the availability of the Platform. 

 

4. Intellectual Property 

  • All content, features, output, and functionality available on the Platform, including but not limited to text, graphics, data, logos, software, and designs, are the intellectual property of Ashoka or  third parties. These are protected under copyright, trademark, and other intellectual property laws. Users may not reproduce, distribute, modify, or otherwise exploit any such intellectual property from the Platform without prior written consent from Ashoka. Any third party content used by the Services to generate the output may be subject to separate terms and conditions, and we are not responsible for them.  

  • The Platform uses AI to generate outputs based on user inputs and accumulated knowledge. While users may have access to AI-generated content and may use it for lawful and intended purposes, Ashoka retains all rights, title, and interest in the underlying AI systems and algorithms. Users are granted a non-exclusive license to use the specific outputs they generate, provided these uses are consistent with these Terms and applicable laws. Users agree that they shall not assert ownership or proprietary claims over the AI technology, its outputs, or the methods used to produce those outputs. 

 

5. Privacy, Data Use, and AI Ethics 

  • We value your privacy and are committed to protecting your personal information. Our use of your data is governed by our Privacy Policy, which outlines how we collect, store, and use information. By using the Platform, you consent to the collection and processing of your data as described in the Privacy Policy. 

  • We aim to maintain transparency about how AI is used on the Platform. The AI algorithms are trained on diverse data sources to provide insights and recommendations. Users acknowledge that the AI systems rely on data patterns and trends, and outputs may not always reflect current knowledge or contextual nuances. 

  • Ashoka recognizes the potential for AI systems to perpetuate biases inherent in their training data. While we actively work to minimize biases and promote fairness, users acknowledge that eliminating all forms of bias is a complex challenge. Outputs should be critically evaluated and used as complementary tools rather than sole decision-making resources. 

  • To enhance the quality and fairness of the Platform’s AI systems, User interactions and inputs may be anonymized and used, from time to time, for   determining “trending questions” asked on the Platform, and preparing reports on the nature of questions fed into the Platform by Users. Usage and retention of User inputs and queries by Ashoka shall be limited to the purposes set out herein. By using the Platform, users consent to the use of their anonymized data for these purposes, subject to the protections outlined in our Privacy Policy.  

 

6. AI-Generated Content and User Accountability 

  • The Platform’s AI-powered tools are designed to assist users in understanding complex ecosystems and generating insights. These outputs should be regarded as supplementary tools rather than definitive guidance. Users are responsible for verifying the accuracy, relevance, and applicability of AI-generated outputs before relying on them for critical decisions. Users also understand that the outputs generated on the Platform based on AI Systems may not always be accurate, and a substitute for professional advice. If the output refers to and/or enables access to the content basis which the output has been generated, the User acknowledges and agrees that this shall not be deemed to be an endorsement of such third-party content by Ashoka.   

  • While users may have access to and utilize the outputs generated by the Platform, the same or similar outputs may be provided to other users. Ashoka does not guarantee exclusivity or originality of AI-generated content.Users are solely responsible for ensuring that the AI-generated outputs they use comply with applicable laws, regulations, and ethical standards in their domain or region. The AI-generated outputs are not subject to any review, verification, or validation prior to it being presented to the User. Ashoka disclaims any liability for how users apply or adapt AI-generated content. You accept and agree that your use of our Services and AI-generated outputs is at your sole risk and understand that any liability incurred in consequence of the reliance on these shall not be attributable to Ashoka.   

 

7. Prohibited Conduct 

  • Users are prohibited from engaging in any conduct that could harm the Platform, its users, or Ashoka. This includes, but is not limited to, actions such as introducing malicious code, unauthorized access to the Platform's systems, misuse of data, or using the Platform for purposes other than those explicitly outlined in these Terms.  

  • Users agree not to reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code or underlying algorithms of the AI systems employed by the Platform. Any violation of this clause may result in legal action and the termination of user access. 8. Limitations of Liability and AI-Generated Content 

The Platform and its services are provided "as is" and "as available," without any warranties of any kind, whether express or implied. Users acknowledge that AI-generated outputs are probabilistic and designed to support decision-making but may contain inaccuracies or biases.  

To the fullest extent permitted by applicable law, Ashoka, its affiliates, officers, employees, agents, partners, licensors, or service providers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, loss of data, loss of goodwill, or any other intangible losses arising out of or in connection with: 

  • Use or Inability to Use the Platform – including any errors, interruptions, delays, or disruptions in service. 

  • AI-Generated Content – including any inaccuracies, errors, or omissions in AI-generated outputs, or any decisions or actions taken by users based on such content.  

  • User-Generated Content – including the transmission of any content through the Platform that may result in damage, loss, or liability.  

  • Third-Party Interactions – including interactions with third-party services or technologies that may be accessed through the Platform. 

  • Breach of These Terms – arising from any breach or violation of these Terms by you or any third party. 

Under no circumstances will Ashoka, its affiliates, officers, employees, agents, partners, licensors, or service providers be liable for any damages, losses, or liabilities, even if Ashoka has been advised of the possibility of such damages.  

You acknowledge and agree that Ashoka will not be liable for any decisions, actions, or outcomes resulting from your use of the Platform, including reliance on AI-generated content or any other information or materials accessed via the Platform.  

 

9. Indemnity 

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Ashoka, its affiliates, officers, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: 

  • Your access to or use of the Platform or its content, including AI-generated outputs. 

  • Any violation of these Terms (including the Privacy Policy or Ethical Guidelines) by you, including unauthorized use of intellectual property or misuse of the Platform. 

  • Your reliance on AI-generated outputs, particularly if such reliance results in harm, errors, or unintended consequences. 

  • Any content you upload or submit, including claims of intellectual property infringement, defamation, or violation of privacy rights. 

  • Any third-party disputes or claims arising out of your use of the Platform. 

 

10. Governing Law and Compliance 

These Terms are governed by the laws of United States of America. Any disputes arising out of this policy will be subject to the exclusive jurisdiction of the courts in Virginia, United States of America.  

Users acknowledge that the use of AI technologies may be subject to evolving laws and regulations. By using the Platform, users agree to comply with all applicable AI-related legal requirements and ensure their activities align with any emerging regulatory standards. 

 

11. Changes to the Terms 

We may revise these Terms from time to time to reflect changes in legal requirements or our Services. Any updates will be communicated through email, in-app notifications, or announcements on our Platform. Continued use of our Services signifies acceptance of the revised Privacy Policy.
